Terms of Service

By creating an account or using notabl ("the Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service.

These Terms, together with Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), govern your license to use the notabl app. Our Privacy Policy (notabl.fm/privacy) explains how we handle your information.

notabl is offered as a public App Store release. The Service evolves over time. Features may change, be added, be reset, or be removed, and in-app data such as collections, ratings, credits, or other virtual items may be adjusted, migrated, or reset. We'll aim to communicate major changes, but use notabl knowing it continues to develop.

You're responsible for your account and for anything that happens under it. You agree to provide accurate information and to keep your login secure.

Age. You must be at least 13 years old to use notabl. If you're under 18, or under the age of majority where you live, you need a parent or guardian's permission to use notabl and to buy anything.

One account per person. Running extra accounts, or teaming up with other accounts to funnel First Presses, referrals or rewards, isn't allowed.

Your phone number. You sign in with a phone number that can receive text messages. Internet (VoIP), pager and voicemail numbers may be refused. Your account is tied to your number. If you lose access to it, contact us. We may help move your account after checking it's you, but we can't promise to.

Bans follow you. A ban can cover your phone number and your device. A banned number can't be used to sign up again, and accounts used on a banned device are locked automatically.

Usernames. No slurs, and no pretending to be notabl, our staff or anyone else. You can change your username once right away. After that, you have to wait 14 days between changes. We may reset a username, display name or bio that breaks these Terms, without notice. Once you give up a username, someone else may take it.

You agree not to:

• Spam, harass, threaten, or abuse other users
• Impersonate other people, artists, or brands
• Cheat, exploit bugs, or manipulate ratings, claims, or marketplace activity
• Create fake or duplicate accounts
• Scrape, reverse engineer, or extract data from the Service
• Use bots or automation to interact with notabl
• Engage in fraudulent, deceptive, or abusive marketplace behavior
• Post illegal, infringing, or sexually explicit content involving minors

These rules also cover how you treat other notabl users in our community spaces, like our Discord server. Serious abuse there can lead to action on your notabl account.

You own the content you create on notabl: profile info, photos, ratings, notes, club chat, marketplace notes, and other submissions ("Your Content"). By posting Your Content, you grant notabl a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as needed to run and promote the Service. You're responsible for making sure you have the right to share what you post.

We can remove content that violates these Terms or that we believe is harmful, illegal, or abusive.

Photos and other uploads. Images you upload, like avatars, banners, profile backgrounds and club photos, are public as soon as you post them. Don't upload anything illegal, sexual, violent or hateful, or anything you don't have the right to share. We may remove any upload and suspend accounts that break these rules.

notabl does not tolerate objectionable content or abusive behavior. You can report content and block other users directly in the app. We review reports and will remove violating content and may suspend or remove users who violate these Terms, typically within 24 hours.

How we moderate. An automatic word filter blocks slurs and hides some links, email addresses and phone numbers. Some content, like song notes and prompt answers, is hidden automatically after several reports until we review it. People on our team review reports. We may remove content, limit features or suspend accounts that break these Terms or the law.

Reporting illegal content. Anyone, including people who don't use notabl, can report content they believe is illegal by emailing contact@notabl.fm. Tell us where it is (a link or username), why you think it's illegal, and your name and email address. Authorities, including in the EU, can reach us at the same address.

If you disagree with a decision. If we remove your content or limit your account and you think we got it wrong, email contact@notabl.fm and a person will look at it. If you're in the UK, you can also use this email to complain about content on notabl or about how we handled a report.

If you believe something on notabl infringes your copyright, email contact@notabl.fm with:

• your name and contact details
• the work you believe is infringed
• where it appears on notabl (a link or username)
• a statement that you believe in good faith the use isn't authorized by the owner, its agent or the law
• a statement that your notice is accurate and, under penalty of perjury, that you're the owner or allowed to act for the owner
• your physical or electronic signature

We may remove content that is reported as infringing, and we may close the accounts of people who repeatedly infringe. If your content was removed and you believe it was a mistake, email us at the same address and tell us why.

notabl uses third-party music metadata, artwork, and previews (including from Apple Music and iTunes). notabl does not own this music and does not claim any rights to it. All music, artwork, and previews remain the property of their respective rights holders, and use is subject to those providers' terms.

notabl isn't affiliated with, sponsored by or endorsed by any artist, label or Apple unless we say so. Cards, share images and games show artwork and short previews to identify the music. Owning a card doesn't give you any rights in the song, the artwork or the artist's name. If you're a rights holder and want something changed, email contact@notabl.fm.

notabl's catalog comes from Apple Music and other sources, and it changes. We may add, merge, split, relink or remove songs, albums and editions. Each edition of an album (like a deluxe or clean version) has its own ladder and its own First Press. When songs are added, merged or removed, your progress on an album or artist can change. If a song is removed, for example because it was listed before its release or at a rights holder's request, the cards and ratings on it may be removed too, and we may refund them at our discretion.

Your items are a license, not property. notabl includes virtual in-app items such as credits, claims, bonus claims, cards, rarity tiers, finishes, collection progress, tags and frames. They're part of the game. We give you a personal, revocable license to use them in notabl. You don't own them. Credits can be earned through in-app activity or bought through the App Store.

• They're virtual only and exist solely within notabl.
• They have no real-world cash value and can't be redeemed for money.
• You can trade some of them with other notabl users inside the app. You can't sell or trade them, or your account, for money or anything outside notabl.
• Credits you buy don't expire.
• We may change how items work, how you earn them and what they do in the game, and items may be adjusted, reset or removed as these Terms describe.
• Your card's position and tier can change without you doing anything. When a card ahead of yours is released, you move up, and a catalog fix can move a card.
• If items came from a refunded purchase, a bug, fraud or a rules break, we may remove them, even if you've spent them. Your balance can go to zero.
• When your account is deleted, your items are gone and your cards go back to the pool. If you're banned, you lose access to your items, and your cards go back to the pool as your collection fades (see section 12), or all at once if we close your account.
• Cards can also go back to the pool if your collection is inactive (see section 12).

Limited tags. A limited tag is limited to its rotation. It may come back later, possibly at a different price.

Position and tier aren't random. Your card's position comes from the order people claimed the song, and our server records that order. #1 is the First Press, and later positions get lower tiers.

Finishes are random. Every card you claim below #1 gets a random finish at the moment you claim it. A card keeps its finish if it later moves up the ladder or changes hands. A card claimed at #1 doesn't get a finish roll. The odds are the same for every claim, whether you use an earned claim or a bonus claim:

You can also see the odds for each special finish in the app. Tap the pressing or stamp label on a card that has one to open The Pressings. The Rarity Index, opened from your full collection, shows how many cards of each finish exist. If the odds change, we'll update them here.

notabl is about active collecting. Your collection stays put as long as you rate a song, claim a song, complete a trade, or buy or sell something at auction at least once every 30 days. Just opening the app doesn't count.

If 30 days pass without any of those, your cards start going back to the pool, one card each night. The most recently claimed cards go first, and your pinned Grails go last. Cards in a pending trade or otherwise held are skipped. When a card is released, the next collector in line for that song moves up.

If we can send you push notifications, we send you a warning when about 18 days have passed without any of those, and we don't release anything until at least 3 days after that warning. You might not see it, for example if notifications are turned off. If we can't send you a push, cards can start going after 30 days with no warning. Your profile in the app also shows when your collection is starting to fade.

Released cards don't come back and aren't paid out. This applies to Premium accounts, suspended and banned accounts, and cards you got in trades or with credits. Any rating, claim, completed trade, or auction purchase or sale stops it.

We may change these timings. If we do, we'll tell you before the change takes effect (see section 27). In rare cases we may pause the clock for an account or hold off on releasing its cards, for example while we fix a problem.

The marketplace and trade features are for notabl virtual collectibles only, not for real-world goods, money, or off-platform exchanges. notabl may cancel, reverse, or remove any listing, offer, or trade that we believe is fraudulent, abusive, broken, or in violation of these Terms.

You can auction a card or a tradable tag for credits.

• When you bid, your credits are held. If someone outbids you, or the auction is cancelled, your credits come back right away. You can't take a bid back.
• Each new bid must beat the current bid by at least 5 credits or 5%, whichever is more. Bids can go up to 100,000 credits, and you can place up to 15 bids on one auction.
• A bid in the last 5 minutes extends the auction so at least 5 minutes are left, up to 30 minutes past the original end time.
• The highest bid when the auction ends wins. If the seller set a Buy Now price, anyone can buy the item right away at that price until bidding reaches it.
• notabl keeps a fee of 10% of the sale price, at least 1 credit, from the seller's proceeds. The fee isn't paid to anyone. It's removed from the economy.
• We may cancel an auction, or reverse a finished one, if there's fraud, a bug or a mistake. A reversed sale may be marked as reversed for a short time.
• Limits on bids and marketplace activity apply and may change.

Starting a club costs 3,000 credits. Adding seats and some club changes, like a new emblem, also cost credits. Refunds are at our discretion, including if a club is archived or club features change. A club's founder can remove members, and the founder and co-leaders can accept requests to join. Club chat is for members only, and these Terms apply there too. Club rewards are set by us. They can be capped, reduced or held back, for example if a club looks like it's being farmed, and they may change or end. Clubs with no members may be archived.

These are the official rules for notabl's games. The Arcade has three games: The Call, Higher or Lower and Name the Record. notabl's games and contests are run by Notabl LLC. Apple is not a sponsor of, and is not involved in, any notabl game or contest.

Rules for every game

• You need a notabl account to play, so you must be at least 13.
• Games are free. You never have to buy anything to play, and paying for anything, including Premium, doesn't change your chances or your prizes.
• Prizes are credits. Credits have no cash value and can't be exchanged for money (see section 10).
• We may cap, change or end any game or its prizes.
• We can void results that come from bugs, scripts, or linked or duplicate accounts, and take back prizes won that way.
• If we run another contest, for example in our Discord server, these Terms apply to it too, along with any rules we post for it.
• Void where prohibited by law.

The Call

• Each week runs from Sunday at 12 AM ET to the next Sunday at 12 AM ET.
• At the start of each week, we pick five songs: the most-claimed songs on notabl over the previous 14 days, with no more than one song per artist. Only songs with cover art can be picked.
• If fewer than five songs qualify, there's no Call that week.
• You can make one pick each week, any time before the week ends. Your first pick is final.
• The winning song is the one with the most counted claims during that week. A claim counts if it was made during the week and is still in someone's collection when we settle, except claims made with bonus claims, claims by anyone who made a pick that week, and claims by accounts our systems link to someone who made a pick (for example, accounts that share a device or an internet connection).
• If two or more songs tie for the most counted claims, they all win.
• Everyone who picked a winning song gets 100 credits. There's no limit on the number of winners, and you can win once a week.
• If no claims count that week, there's no winning song and no credits are paid.
• We settle each week shortly after it ends, and credits are added to your balance automatically.

Higher or Lower

• Each round shows two songs by different artists. Pick the one with the higher average rating on notabl.
• Higher or Lower doesn't pay credits. It's for your streak.

Name the Record

• Each round plays a short clip of a song. You get up to 5 guesses at the song's title.
• Capitalization, punctuation, and featured artists or version labels (like remix or live) in brackets don't matter.
• A correct guess pays credits based on how many guesses you used: 10 credits on the first guess, 5 on the second, 3 on the third, 2 on the fourth and 1 on the fifth.
• Only your first 5 correct rounds each day pay credits. Each day starts at 12 AM ET. After that, you can keep playing for your streak.
• If you give up or run out of guesses, the round ends with no credits.

You may earn in-app rewards (such as credits or tags) for inviting new users who sign up and qualify through your referral link or invite code. Rewards may be withheld, revoked, or reversed if we detect abuse, fake accounts, self-referrals, or any attempt to manipulate the referral system. Reward amounts and qualification rules may change.

Today, you and your friend each get 50 credits once your friend has claimed at least one song and has had their account for at least 3 days. We may also check that they're still active. You can earn referral credits for up to 10 friends in any 7 days. Invites between accounts on the same device don't count. Invite milestones can unlock Premium, as shown in the app, and bigger milestones need our approval. Referral contests follow section 16.

If you share your invite link publicly to win a prize or reward, make it clear that you get something when people join, for example "I get credits if you sign up".

Creator Program. The Creator Program is a separate program you apply to at notabl.fm/creators. It pays money, not credits, for qualified sign-ups, and it has its own rules, posted on that page. If you're in the program, these Terms apply to you and those rules are part of them. If those rules and this section differ, those rules apply. You must be 18 or older to be in the program. Creators are independent. They aren't our employees or agents and they don't speak for notabl. We can turn down any application, change or end the program, and remove a creator who breaks the rules. You're paid only for sign-ups that follow the rules, and our records decide whether a sign-up counts. People who join with a creator's code get that creator's tag. A creator's code isn't an invite code, so it doesn't earn referral credits.

notabl offers optional paid features. These currently include notabl Premium, an auto-renewing subscription, and Credits, a consumable in-app currency sold in packs. All purchases are made through Apple's in-app purchase system and are subject to Apple's billing terms.

notabl Premium. The Premium plans available to you and their prices are shown in the app before you buy. Payment is charged to your Apple Account when you confirm the purchase. Your plan renews automatically for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the period ends. You can manage or cancel your subscription anytime in your Apple Account settings. Deleting your notabl account, or being suspended or banned, doesn't cancel your subscription. Only you can cancel it, through Apple.

What Premium includes is shown in the app and may change over time. Premium includes 500 credits, added to your balance when you open the app if it's been at least 30 days since your last Premium credits. The next 30 days count from that moment, so time before you open the app isn't made up later.

We sometimes give Premium for free, for example as a prize, a referral reward or a thank you. Free Premium isn't billed through Apple.

Credits and bonus claims. Credits you buy don't expire. You can use credits to buy bonus claims in the Shop, up to 20 bonus claims a week, or 40 with Premium. This limit resets every Sunday at 12 AM ET.

Except where required by law or by Apple's policies, purchases and Credits are non-refundable, and Credits and other virtual items have no cash value and can't be exchanged for money. To ask for a refund, use Apple's Report a Problem page (reportaproblem.apple.com). We can't refund App Store purchases ourselves. Prices, features, and availability of paid offerings may change.

If something goes wrong, like a bug, a wrong price, a wrong edition, fraud or a rules break, we may undo or correct the result. That can mean moving cards back, cancelling or reversing trades, sales, auctions, prizes or rewards, and taking back credits. We decide case by case and try to be fair to everyone involved. We may note publicly that a sale was reversed.

We may suspend or remove your account at any time for violations of these Terms, abusive behavior, or any reason we believe is necessary to protect the Service or its users. You can stop using notabl or delete your account at any time.

If you break the rules, we may limit your trading, auctions and Buy Now, suspend your account so you can't sign in, or ban you. Accounts suspended from signing in are left off the collector leaderboards in the app. Suspensions last until we lift them, and your collection can still fade while you're suspended (see section 12). If we ban you, you can't sign in again and you lose access to your credits, tags and other items. Your cards go back to the pool as your collection fades (see section 12), or all at once if we close your account. A ban or suspension doesn't cancel an Apple subscription, so cancel it in your Apple Account settings. To appeal, email contact@notabl.fm.

notabl staff and some friends of the app collect and trade like everyone else. Some accounts get Premium or other perks from us, for example as thanks, for testing or as prizes.

notabl is provided "as is" and "as available," without warranties of any kind. notabl may have bugs, downtime, or data loss. To the fullest extent permitted by law, notabl and its operators are not liable for any indirect, incidental, special, or consequential damages, or loss of data, profits, or virtual items arising from your use of the Service.

You agree to defend, indemnify, and hold harmless Notabl LLC and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to the extent such liability cannot be limited under the mandatory law of your country of residence.

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules. Nothing in this section deprives consumers of the protection of mandatory laws of their country of residence.

Before bringing any formal claim, you agree to first contact us at contact@notabl.fm so we can try to resolve it informally. To the fullest extent permitted by law, disputes will be resolved on an individual basis, and you and notabl waive the right to bring or participate in a class action. This section does not apply to claims that may be brought in small-claims court and does not limit mandatory consumer rights for users in the EU or other jurisdictions where such waivers are not permitted.

If you are a consumer in the European Union, United Kingdom, or European Economic Area, nothing in these Terms limits or excludes rights that cannot be limited or excluded under the mandatory consumer-protection law of your country. The "as is," liability, governing-law, and dispute provisions apply only to the extent permitted by such law. Your statutory cancellation and refund rights for purchases are handled through Apple.

We may update these Terms from time to time. When we do, we'll change the version and dates at the top. We'll tell you about important changes in the app or by other reasonable means before they take effect. Continuing to use notabl after changes take effect means you accept the updated Terms. If you don't agree, you can stop using notabl and delete your account.

Ideas and feedback. If you send us ideas or feedback, we can use them without paying you or owing you anything.

Other services. When you connect Last.fm or Discord, their terms and privacy policies also apply.

The whole agreement. These Terms, the Privacy Policy, any rules we post for a contest (see section 16), the Creator Program rules and any written deal we make with you if you're a creator (see section 17), and Apple's standard license agreement are the whole agreement between you and us about notabl.

If part doesn't hold up. If a court finds any part of these Terms can't be enforced, the rest still applies.

No waiver. If we don't enforce something right away, we can still enforce it later.

Transfer. We may transfer these Terms to a company that takes over notabl. You can't transfer your account or these Terms.

Things outside our control. We're not responsible for delays or failures caused by things we can't reasonably control, like outages at our providers.

Sanctions. You can't use notabl if you're in a country or on a list that US sanctions law bars us from serving.

What survives. The parts of these Terms that should keep applying after your account ends, like the item license rules, disclaimers, limits of liability, indemnity and dispute terms, still apply.
