Terms of Service

Notabl is operated by Notabl LLC ("Notabl," "we," "us"), a Missouri limited liability company. These Terms govern your access to and use of the Notabl app and website via the App Store. Effective June 8, 2026.

1. Acceptance of terms

By creating an account or using Notabl ("the Service"), you agree to these Terms of Service. If you don't agree, please don't use the Service.

These Terms, together with Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/), govern your license to use the Notabl app.

2. Service availability and changes

Notabl is offered as a public App Store release. The Service evolves over time: features may change, be added, be reset, or be removed, and in-app data such as collections, ratings, credits, or other virtual items may be adjusted, migrated, or reset. We'll aim to communicate major changes, but use Notabl knowing it continues to develop.

3. Accounts

You're responsible for your account and for anything that happens under it. You agree to provide accurate information (including a valid phone number for authentication) and to keep your login credentials secure. You must be at least 13 years old to use notabl.

4. User conduct

You agree not to:

  • Spam, harass, threaten, or abuse other users
  • Impersonate other people, artists, or brands
  • Cheat, exploit bugs, or manipulate ratings, claims, or marketplace activity
  • Create fake or duplicate accounts
  • Scrape, reverse engineer, or extract data from the Service
  • Use bots or automation to interact with Notabl
  • Engage in fraudulent, deceptive, or abusive marketplace behavior
  • Post illegal, infringing, or sexually explicit content involving minors

5. User content

You own the content you create on Notabl — profile info, ratings, tags, marketplace notes, and other submissions ("Your Content"). By posting Your Content, you grant Notabl a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as needed to run and promote the Service. You're responsible for making sure you have the right to share what you post.

We can remove content that violates these Terms or that we believe is harmful, illegal, or abusive.

Notabl does not tolerate objectionable content or abusive behavior. You can report content and block other users directly in the app. We review reports and will remove violating content and may suspend or remove users who violate these Terms, typically within 24 hours.

6. Music metadata

Notabl uses third-party music metadata, artwork, and previews (including from Apple Music / iTunes). Notabl does not own this music and does not claim any rights to it. All music, artwork, and previews remain the property of their respective rights holders, and use is subject to those providers' terms.

7. Virtual items: credits, claims, cards, rarity, tags

Notabl includes virtual in-app items such as credits, claimed cards, rarity tiers, collection progress, and tags. These items:

Credits may be earned through in-app activity or purchased through the App Store.

  • Are virtual only and exist solely within Notabl
  • Have no real-world cash value and cannot be redeemed for money
  • Cannot be sold or transferred outside the Service
  • May be adjusted, reset, or removed at any time

8. Marketplace and trades

The marketplace and trade features are for Notabl virtual collectibles only — not for real-world goods, money, or off-platform exchanges. Notabl may cancel, reverse, or remove any listing, offer, or trade that we believe is fraudulent, abusive, broken, or in violation of these Terms.

9. Referrals and rewards

You may earn in-app rewards (such as credits or tags) for inviting new users who sign up and qualify through your referral link or invite code. Rewards may be withheld, revoked, or reversed if we detect abuse, fake accounts, self-referrals, or any attempt to manipulate the referral system. Reward amounts and qualification rules may change.

10. Paid features, subscriptions & purchases

Notabl offers optional paid features. These currently include Notabl Premium — an auto-renewing monthly subscription — and Credits, a consumable in-app currency sold in packs. All purchases are made through Apple's in-app purchase system and are subject to Apple's billing terms.

Payment is charged to your Apple Account at confirmation of purchase. Notabl Premium automatically renews at the monthly price shown in the app unless auto-renew is turned off at least 24 hours before the end of the current period; your Apple Account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription anytime in your Apple Account settings.

Except where required by law or by Apple's policies, purchases and Credits are non-refundable, and Credits and other virtual items have no cash value and cannot be exchanged for money. Certain purchases (such as bonus claim packs) may be subject to weekly or other limits. Prices, features, and availability of paid offerings may change.

11. Suspension and termination

We may suspend or remove your account at any time for violations of these Terms, abusive behavior, or any reason we believe is necessary to protect the Service or its users. You can stop using Notabl or request account deletion at any time.

12. Disclaimer and limitation of liability

Notabl is provided "as is" and "as available," without warranties of any kind. Notabl may have bugs, downtime, or data loss. To the fullest extent permitted by law, Notabl and its operators are not liable for any indirect, incidental, special, or consequential damages, or loss of data, profits, or virtual items arising from your use of the Service.

13. Indemnification

You agree to defend, indemnify, and hold harmless Notabl LLC and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party. This does not apply to the extent such liability cannot be limited under the mandatory law of your country of residence.

14. Governing law

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules. Nothing in this section deprives consumers of the protection of mandatory laws of their country of residence.

15. Dispute resolution

Before bringing any formal claim, you agree to first contact us at contact@notabl.fm so we can try to resolve it informally. To the fullest extent permitted by law, disputes will be resolved on an individual basis, and you and Notabl waive the right to bring or participate in a class action. This section does not apply to claims that may be brought in small-claims court and does not limit mandatory consumer rights for users in the EU or other jurisdictions where such waivers are not permitted.

16. EU consumers

If you are a consumer in the European Union, United Kingdom, or European Economic Area, nothing in these Terms limits or excludes rights that cannot be limited or excluded under the mandatory consumer-protection law of your country. The "as is," liability, governing-law, and dispute provisions apply only to the extent permitted by such law. Your statutory cancellation and refund rights for purchases are handled through Apple.

17. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll let you know through the app or by email. Continuing to use Notabl after changes take effect means you accept the updated Terms.
