Terms of Service

Eligibility

You must be at least 13 years old to use Notabl. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed these Terms with you. By using the Service, you represent that you meet these requirements.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms, engage in abusive behavior, or remain inactive for an extended period.

User content

You retain ownership of content you create on Notabl, including posts, ratings, and profile information ("Your Content"). By posting Your Content, you grant Notabl a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content for the purpose of operating and promoting the Service. This license ends when you delete Your Content, except where retained for legal or backup purposes.

You agree not to post content that is:

  • Illegal, infringing on others' intellectual property, defamatory, or harassing
  • Sexual content involving minors (we will report to authorities)
  • Spam, scams, or malicious content
  • Content you do not have the rights to share

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat infringers.

Music and third-party integrations

Notabl integrates with Apple Music to surface song metadata, album artwork, and 30-second previews provided by Apple. We do not store full song files. All music is the property of its respective rights holders. Use of music previews and metadata is subject to Apple Music's terms of service.

The "claim" feature on Notabl is a digital collection mechanic. It does NOT grant you any ownership, license, or rights to the underlying music. It is a record of your engagement with the song within the Notabl community.

DMCA / copyright

If you believe content on Notabl infringes your copyright, send a notice to copyright@notabl.fm with: your contact information; identification of the copyrighted work; identification of the allegedly infringing content; a statement of good faith belief that the use is unauthorized; a statement under penalty of perjury that the information is accurate; and your physical or electronic signature.

Prohibited conduct

  • Reverse engineer, scrape, or extract source code from the Service
  • Use the Service to harass, threaten, or abuse other users
  • Create multiple accounts to manipulate claim positions or ratings
  • Impersonate others or misrepresent your affiliation
  • Bypass any security or rate-limiting measures
  • Use bots or automated tools to interact with the Service

Purchases and paid features

Notabl does not currently offer paid features. If we introduce paid features, additional terms will apply. All purchases would be processed through Apple's App Store and subject to Apple's terms.

Termination

You may delete your account at any time through the App settings. We may terminate or suspend your account at our discretion, with or without notice, for any violation of these Terms or for any other reason. Upon termination, your right to use the Service ends immediately.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOTABL AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Notabl and its operators from any claims arising from your violation of these Terms or your use of the Service.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the App or by email. Continued use of the Service after changes constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Missouri.
